New Section 182 Guidance Published 2018

The Home Office have now published the latest version of the ‘s. 182’ Guidance.

This Guidance is directed to licensing authorities on the discharge of their functions under the 2003 Act. 

The new Guidance takes immediate effect from the date of publication.  All applications received by the licensing authority on or after the date the revised Guidance was published (24th April 2018) will be processed in accordance with new version.  Applications made prior to the publication of the revised Guidance, should be processed in accordance with the Guidance in effect at the time the application was made.

When making a decision a licensing authority must have regard to this Guidance and it is therefore a very significant document in terms of licensing

The new version includes a number of minor and major revision including advice to licensing authorities on the new requirement for Cumulative impact assessments (paragraph 14.24), which recently came into force.
